FORT SMITH, Ark. (AP) - A Sebastian County Circuit Court judge is refusing to seal investigative files in the case of a man charged with using a machete to kill two Fort Smith men.

The Southwest Times Record reports that Judge Stephen Tabor on Tuesday denied the motion by attorneys for Gregory Aaron Kinsey. The defense attorneys argued that releasing the file could lead to pretrial publicity and deny Kinsey a fair trial.

Tabor said there is little in the file that hasn't already been released and said he's confident an unbiased jury can be found.

Kinsey has pleaded not guilty to capital murder in the June 26 deaths of Brandon Prince and Nathan Young. Witness said Kinsey attacked the men when they confronted him outside their homes where he had stopped while walking.
