SWEPCO said Monday it would hold an afternoon news conference Monday to discuss its plans. On Wednesday, the Arkansas Court of Appeals ruled that the Public Service Commission had not followed proper procedures in holding hearings on the proposed plan. The court was also critical of how the site in Hempstead County was selected.
The appeals court ruling said SWEPCO would have to file a new application for the plant with the PSC if it still wanted to build the plant.
The utility can appeal the ruling to the Arkansas Supreme Court.
